Robowholesaler organizes fund categories and selects featured funds based solely on performance data made available by individual fund companies. Content displayed on this Website does not constitute any recommendation to buy or sell any security and should be used for informational purposes only. The fact that a fund is featured on the Website does not constitute a ranking and Robowholesaler is not advocating for the sale or purchase of any featured funds. Your use of data or content published on robowholesaler.com is entirely at your own risk, and it is your responsibility to evaluate the accuracy, completeness, and usefulness of content published on the Website.

Fund Fact Sheets are produced quarterly and provide a summary of fund information including performance, top holdings and key fund data, and portfolio characteristics. ALL FUND FACT SHEETS MADE AVAILABLE BY THIRD PARTIES THAT ARE ACCESSIBLE ON ROBOWHOLESALER.COM ARE SUBJECT TO THE ADDITIONAL TERMS AND CONDITIONS STATED ON THE THIRD-PARTY-PROVIDERS’ WEBSITES.

This Website should not be considered a solicitation or offering of any investment products or services to investors residing either within or outside of the United States. All mutual funds are offered by prospectus only. Mutual fund prospectuses include investment objectives, risks, fees, expenses, and other information that you should read and consider carefully before investing.

Governing Law and Jurisdiction

All matters relating to the Website and these Terms and any dispute or claim arising therefrom or related thereto (in each case, including but not limited to non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice or conflict of law provision or rule (whether of the State of New York or any other jurisdiction).

Any legal suit, action or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York, in each case located in the City of New York, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

At Robowholesaler’s sole discretion, we may require you to submit any disputes arising from the use of these Terms or the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying New York state law.

Limitation on Time to File Claims

Any cause of action or claim arising out of or relating to these Terms or the Website must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

Waiver and Severability

No waiver by Robowholesaler of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Robowholesaler to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

The Terms and our Privacy Policy constitute the sole and entire agreement between you and Robowholesaler with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website. Headings are for convenience only and do not affect the meaning or interpretation of these Terms.
